Last week the United States Supreme Court decided a case which refines a commonly debated interpretation of the?Real Estate Settlement Procedures Act (?RESPA?)?by lower courts. ?RESPA?is a Federal law that plays a significant role in how real estate brokerage companies (among others) conduct day-to-day business. ?It has myriad prohibitions, restrictions and disclosure requirements that are applicable to such ?settlement service providers? as title companies, mortgage lenders, real estate brokers and more. ?Generally, it prohibits referral fees and unearned fees by settlement service providers in connection with a federally-related mortgage, imposes restrictions and requirements on ?affiliated business providers?, mandates certain disclosures to increase transparency of transactions for consumers, and more.

Until this month, the issue of how RESPA impacts ?administrative fees? charged by real estate brokers and agents was a controversial and often debated real estate brokerage issue, nationwide. ?There was a split in how the decisions in various cases across the country interpreted Section 2607(b) of RESPA. ?That section provides:

?[n]o person shall give and no person shall accept any?portion, split, or percentage of any charge made or received for the rendering of a real estate settlement service [...] other than for services actually performed.? 12 U. S. C. ?2607(b)

The various split in decisions and HUD interpretations addressing this issue left some unanswered questions as to whether a real estate brokerage would find itself in hot water when charging an ?administrative fee? or similar charge in addition to a commission, if the real estate broker could not readily identify what service was being rendered pursuant to that admin fee.

The United States Supreme Court decided a case last week (May 24, 2012) which clarifies this issue significantly, and simplifies this issue for real estate brokers. ?In the case of Freeman v. Quicken Loans, the Supreme Court found that there is no?violation of ?2607(b) of RESPA without showing that a charge for a settlement service was divided with a third party.

In short, this author suspects that some of the national controversy and confusion surrounding real estate brokerage admin fees will now become an easier topic to ?address consistently, and with less controversy. Prior cases, including the controversial 2009 decision in Busby v. JRHBW Realty, Inc. d/b/a Realty South, had suggested that merely charging an ?admin fee? in addition to a commission, even if it is disclosed to the consumer paying such fee, is in and of itself a violation of RESPA. ?In January 2010, a HUD letter from Helen Kanovsky (Office of the General Counsel at HUD) clarified that there may be some room from brokerages to have commissions composed of a flat fee or commission or both.

Now that the?Supreme?Court has weighed in, it would seem likely that admin fees charged by real estate brokers should draw less scrutiny. ?Additionally, the prior caselaw and unfavorable decisions interpreting RESPA in such a way as to further restrict the real estate industry than was explicitly stated in RESPA are probably of dramatically less impact, or their impact is narrowed significantly by this decision.

Stay tuned to the Thomsen Nybeck Legal Update blog for further discussion of this issue as more information, interpretations, and decisions bring this issue into even sharper focus. ?For now, real estate brokerage companies, agents, and brokers who charge (or have ceased charging) administrative fees may wish to discuss these issues once again with their legal counsel to identify how they want their business practices to fit within the fluid and evolutionary laws surrounding these practices.

BAKU, Azerbaijan (AP) ? Security services in Azerbaijan say they have arrested 40 suspects and seized weapons as they thwarted a series of planned terror attacks against the Eurovision Song Contest.

Targets included the song contest venue and major hotels housing foreigners, the National Security Ministry said in a statement Wednesday.

Azerbaijan has in recent months reported being the target of terrorist activities planned by groups with ties to Al-Qaida and Iran, and this appears to be most extravagant alleged plot revealed to date.

An oil-rich nation of 9 million people wedged between Russia and Iran, Azerbaijan has nurtured close relations with the United States and played an active role in Western-led counter-terrorist programs. That policy has placed a strain on its ties with Iran, which hosts a sizable ethnic Azeri community.

The statement Wednesday said other plots included plans for an assassination attempt on President Ilham Aliyev in April, as well as attacks on religious pilgrimage sites and police stations.

Officials said 40 people have been arrested. Weapons seized included 13 assault rifles, one machine gun, 12 handguns, three rifles, 3,400 rounds of bullets, 62 hand grenades, and several kilograms of explosives.

The statement provided no details on when the arrests took place.

"The armed group set itself the aim of mounting terrorist attacks in several regions of Azerbaijan, creating a mood of powerlessness and lawlessness, sowing panic, ethnic and religious enmity, disrupting the public peace and damaging Azerbaijan's international image," the statement said.

The Eurovision attack would have centered on the Baku Crystal Hall, where the singing competition concluded early Sunday, officials said. Other planned targets included Marriot and Hilton hotels in the capital, Baku.

At least one suspected plotter, 37-year-old Azerbaijani citizen Vugar Padarov, and a security agent were killed during raids to shut down the terrorist group, the statement said.

Padarov was identified in an April security statement as the leader of a group that had received religious training in Syria. Some of its members had weapons training with the Jihad Islami group in Pakistan and took part in fighting NATO-led troops in Afghanistan, the National Security Ministry said.

In March, the ministry announced the arrests of 22 Azerbaijani citizens it said had been hired by Iran to stage terror attacks against the U.S. and Israeli embassies as well as against western-linked groups and companies. It said they had been trained in Iran by the Revolutionary Guard.

Earlier this year, it announced the arrest of several other suspected terrorists allegedly working for Iran's secret services.

Other companies seem to agree too. GM's rivals like Hyundai, Kia, Nissan all but echoed GM's concerns about the return on investment associated with Facebook advertising. Ryan Holiday, an online media buyer for American Apparel, all but pulled out of the Facebook advertising programme, cutting his spending on the site from nearly $1 million per year to "a few thousand dollars a month".

Then, there are the rather humbling steps that Facebook had to take as it settled claims in a lawsuit over sponsored stories, where the social network used the names, photos and identities of users to advertise products without their express permission. Given that there are nearly 157 million registered Facebook users in the US (about half the total population), a class action lawsuit could have proved to be devastating for Facebook's attempts to challenge Google in the advertising market.

And last but not least, Morgan Stanley, the lead underwriting financial institution in Facebook's IPO has been hit by a subpoena "in connection with the analyst's discussion with certain institutional investors about the revenue prospects for Facebook". It looks like Morgan Stanley abruptly cut its revenue forecasts for Facebook just days before the company went public. This follows calls by the Securities and Exchange Commission and the Financial Industry Regulatory Authority for a review of the IPO.

The latest rumour revolves around a contract that was leaked online by the LA Times that showed a developing contract between Activision, Blizzard and Bungie for a new MMO (massively multiplayer online) product called Destiny and refers to the Xbox 720 by name.

The interesting bit is that Destiny is set to launch in November 2013, which suggests that Microsoft's next generation console could be out at the same time. The Xbox 360 was launched in November 2005 and the original Xbox hit the streets in November 2001. So it is likely that 2013 will be the year of the Xbox with potential key dates being the Game Developers Conference (in March), E3 (in June) and the few weeks following Black Friday, which marks the beginning of the lucrative Christmas shopping season in the US.

There has been a slew of wild rumours from unnamed sources claiming that the Xbox 720 will sport a 16-core CPU, two GPUs, a new version of Microsoft Kinect, will be six times faster than the Xbox 360 and will ship without any optical drive and with a Nintendo Wii-U-like tablet style controller.

My take on it is that the Xbox 720 will be the last dedicated gaming console that Microsoft will bring to market. The years ahead are likely to confirm the hegemony of mobile hardware technology and the rise of cloud-based gaming which requires no physical media, while being permanently locked in a stop/start mode, means that a 16-core smartphone in 2015 could be just as powerful as an Xbox 720 and replace it as a gamer's only gaming platform (it still won't have a decent controller though - ed.).

KATMANDU, Nepal (AP) ? Nepal sank into political turmoil Monday after lawmakers failed to agree on a new constitution, leaving the country with no legal government. The premier called new elections, but critics said he lacked the power to do so.

Security forces went on high alert, although Katmandu was largely quiet due to a national holiday. Riot police patrolled the streets after several political parties called for rallies to demand the resignation of Prime Minister Baburam Bhattarai and protest his unilateral decision to call elections for November.

"The country has plunged into a serious crisis," said Ram Sharan Mahat, a senior leader of the country's second-largest party, the Nepali Congress, who said that six months would not be enough time to prepare for new polling.

"This government has no legitimate grounds to continue," he said.

The squabbling political parties in Nepal's Constituent Assembly had failed to agree on a new blueprint for the Himalayan nation by their own deadline of midnight Sunday, despite repeated extensions of the due date over the past four years.

A key sticking point was whether the country's states should be drawn to give regional power bases to ethnic minorities.

Writing the new constitution was supposed to cap an interim period aimed at solidifying details of Nepal's democracy after the country turned the page on centuries of royal rule and resolved a decade-long Maoist insurgency by bringing the former combatants into the political mainstream.

Bhattarai, from the party of former Maoists, said the previous constitutional assembly, elected four years ago, had failed and must be dissolved, and that he would head a caretaker government until the Nov. 22 elections.

"We have no other option but to go back to the people and elect a new assembly to write the constitution," Bhattarai said in his announcement.

However, his plan immediately drew criticism from legal experts, who said any plans for new polling should be made in consultation with the country's other political parties.

"It was politically, legally and morally incorrect of the prime minister to announce fresh election," said constitutional and legal expert Bhimarjun Acharya.

Police spokesman Binod Singh said thousands of police officers have been deployed in Katmandu and major cities across the country to stop any violence in coming days.

Police had clashed briefly with protesters Sunday outside the Constituent Assembly, where political leaders from the country's four main parties had been meeting in a last-minute attempt to agree on a new constitution before the deadline.

Much of the debate was over whether to draw state boundaries in a way to boost the political power of the country's ethnic minorities.

Nepal's minority ethnic groups and low-caste communities were overshadowed for centuries by the country's elite. In the past couple years, as Nepal has struggled to create a new government, those divisions have given rise to caste- and ethnic-based politicians, who insist their long-marginalized communities deserve to live in states that maximize their influence.

Thousands of protesters opposed to states drawn along ethnic and caste lines tried to push through a riot police blockade. Police pushed back and a scuffle ensued, with protesters throwing stones and police responding with tear gas and batons. Three policemen and several protesters were injured.

On the other side of the assembly hall, thousands of people demonstrated in support of states based on ethnicity. A thick police line kept the opposing groups apart.

The Constituent Assembly was elected to a two-year term in 2008 to draft a new constitution but has been unable to finish the task. Its tenure has been extended four times, but the Supreme Court rejected any further extensions.

The assembly's formation came two years after pro-democracy protests forced Nepal's king to give up authoritarian rule and restore democracy in the country. One of the assembly's first decisions was to abolish the centuries-old monarchy and convert Nepal into a republic.

The political parties have been able to resolve some other thorny differences in the past, including the future of thousands of Maoist rebel fighters who were confined to camps after giving up their armed revolt in 2006. However, they have not been able to agree on the ethnic issue.

Report: Israel Killed 55 Civilians in Occupied Territories in 2012

The annual Amnesty International report on human rights has once again faulted the Israeli government for its regular use of excessive force against Palestinian civilians, and put the overall death toll at 55 civilians, including 11 children. Anti-Gay Marriage Legislation is an Example of An Overextended Church in Decline

No longer content to govern itself, the church has spread out to rule the culture through legislative force, attempting to?use the tools of government to order the lives of?consenting?adults.?Like an empire, the church finds itself on patrol?beyond its rightful territory, which is shocking when one considers how much space the church has been given, by God first and this country second.

The church already possesses the freedom to?engage the culture through dialogue, art, the marketplace of ideas, hospitality, care, and robust teaching. We have the right to share and live the good news of Christ resurrected. We have the reach to notice, defend, and love the orphans, the widows, the poor, the hungry, the outcast, the falsely condemned, the unjustly treated, and victims of violence and coercion. We have the liberty to love our neighbors and our enemies. We have Micah 6:8:

And what does the Lord require of you? To act justly and to love mercy and to walk humbly with your God.

Why is it not enough?

The state of discontent in our faith is not the fault of the GLBT community. Perhaps we have become discontented with the humility and quietness of actual faith and ministry. If so, this is tragic. In a culture embracing unhinged consumerism, it is not surprising that the church would grow bored of the feast of ministry, moving on to snack on private affairs within the broader culture.

In a quest for church strength and national longevity, our cultural conquests are making the church and the nation weaker and more divided. In a crusade for a more wholesome culture, we have injected pride, arrogance, hostility, and vitriol. Even those who respectfully stand against an issue that is at most a symbolic victory have contributed to the creation of unnecessary foes.

Justice for the abused and disadvantaged rather than the consensual

I have heard gay marriage argued against with the example of Nazi Germany, by people asking ?where was the church then?? They say genocide is what happens when we fail to act on our morals as a church. I find it troubling that this is even considered a valid comparison to the GLBT community?s wish to marry. One is force, the other is?consensual. Force turns sex into rape and employment into slavery. This is why the church is universally applauded when it combats sex trafficking, and esteems people otherwise harmed, neglected or left behind, because in those moments the church is elevating the individual rather than trying to restrict it.

This is why Christians must find that tension between being completely disengaged from the broader culture, or consumed by it, and consumed can come in different forms. One form tries to water down personal faith to the extent that he or she is indistinguishable from the broader culture. Another tries to fashion the culture to look like his or her faith. The latter is what we see in the anti-gay marriage movement.

The church has been here before (and survived)

The reason no one will be making the argument against gay marriage in twenty years is the same reason the average person would not be in agreement with Christians advocating for laws against all alcohol consumption, tattoos, or cursing, even though some Christians sincerely view those as sins and have what they feel are the verses to back it up.

Go with me a step further, those of you who are against gay marriage in the broader culture, and let me attempt to discuss this on your terms over the next three paragraphs.

Remember the fight against pornography? The Religious Right lost that battle too. But while pornography rakes in billions of dollars in the U.S. annually, the church has not been silenced. In fact, the church has quite a multifaceted approach to the problems stemming from porn. The dangers of pornography are still preached from the pulpit, churches offer counseling or connection with counseling services for porn and sex addicts, some churches exist solely to befriend those within the adult industry as well as those men and women recovering from their participation in the production or consumption of porn, and non profits are built to walk with women who have been harmed by their experience in the adult industry. It?s by no means a perfect example, but I hope those of you who disagree with gay marriage in the broader culture see this point and will reconsider your approach: while porn is here, so too is the church. Sometimes, I think losing the culture battle is the best thing for the church, so that it can remember its place and then get back to its calling.

When you look at Christ, do you see Him forcing teaching or standards of living on everyone? He taught people to seek- as Rev. Earl F. Palmer said so correctly- seek is a freedom word. That means ministry is intended to grant people the dignity of choice as well as our patience. These ideas can be held along with the charge to go and make disciples.

Jesus also told stories. He was silent at times, refusing to answer. Or he answered questions with other questions. He went where he was welcomed, and often retreated from the crowds or the mobs. Hardly an in your face kinda guy. When Jesus did chide, it was most often reserved for the religious know-it-alls and fruitless trees.?Christ also raged when he witnessed a perversion of the church, and if you see gay marriage in the broader culture as the same thing, you are forgetting to remember that this nation is not your personal house of worship. That?s what your house of worship is for.?It?s time to stop trying to force other people to eat your vegetables. Gay marriage is no more a threat to your marriage than the divorced neighbor or the guy down the street who just had an affair. The greatest threat to your marriage is what you and your spouse do or don?t do with it.

The point of it all: fruit, not culture feuds

Belief in Christ is a transformative journey, producing fruit and a sincere effort in obedience, and while the fruit, or goodness does not save us, it is a sign of Christ?s transformation in those who believe. Belief must produce a new motion in our lives, and not towards every endeavor we happen to bless, but towards actions which bring glory to God.

But the fruit?of the Spirit is love,?joy, peace,?forbearance, kindness, goodness, faithfulness,?gentleness and self-control. -Galatians 5:22-23

The church mistakes earnestness for righteousness. ?Well as long as I?m using scripture to back it up.? Did Jesus accept that justification from the religiously earnest who knew their religious law and used it as a disproportionate weight on the backs of others??The epidemic problem in the American church is that we have become ?position people,? swapping faith for a mental concept, and mistaking ministry for being on the correct side of an issue. This is my guess as to why the church is so often absent on matters where it is actually needed, because we have become satisfied with the notion that we just need to think correctly and tell others to do the same and God will smile down on us all.

We can know The Good Book like a pro, and still fail to live the point of it all. The Bible, if mishandled, can further a person?s quest for power and control.?So what is the fruit of fighting against gay marriage in the broader culture? Because the anti-gay marriage culture warriors are making enemies whether they mean to or not. This isn?t to say those who oppose gay marriage are incapable of producing fruit elsewhere; it is to say that the church movement to stop gay marriage in the broader culture has been a largely fruitless campaign.

I once saw a photo of a protest sign at a pro-equality rally in Seattle that read ?focus on your own family.? That is Biblical advice. It is the work of God through his spirit that changes hearts, not the church as the Morality Police, especially not when we focus on the deeds of consenting adults in the broader culture, and most certainly not when we try to enforce it by way of legislation. We?re getting our kingdoms confused, and that is not salt nor light.

Weekly Ketchup: Tom Cruise to Remake The Magnificent Seven

This week's Ketchup is heavy with news about remakes (Robocop, The Magnificent Seven), villain news for Iron Man 3 and Thor 2, and new roles for Sandra Bullock, Zach Galifianakis, Gary Oldman, and Seth Rogen. Often Hollywood seems to shut down the news-making side of the movie-making business right before holiday weekends, but this year's Memorial Day weekend, not so much!

This Week's Top Story

TOM CRUISE TO REMAKE THE MAGNIFICENT SEVEN

Among Tom Cruise's current slate of potential upcoming movies are at least two reboots/remakes (A Star is Born and Van Helsing), and this week, another one joined the list. MGM, a studio that's all about remakes these days (Carrie, Red Dawn, Poltergeist, Robocop, etc), has started development on a remake of the 1960 western The Magnificent Seven, which was itself a remake of Akira Kurosawa's 1954 film Seven Samurai. And, as you can tell from the way this article started, Tom Cruise is already attached to star as one of the seven American gunfighters that are hired to defend a Mexican town from a gang of outlaw banditos. That, however, is as much as we know right now. Other very important answers, such as who will be hired to write the adaptation, who will direct, who will play the other six gunslingers, and whether the setting will remain in the 19th century (or be modernized), are all subjects that are very much in the wind right now.

Fresh Developments This Week

#1 WILL ZACH GALIFIANAKIS FINALLY BE IGNATIUS J. REILLY IN A CONFEDERACY OF DUNCES

The Pulitzer Prize winning novel A Confederacy of Dunces by John Kennedy Toole is a book that from its very origin has always been shrouded in unusual events, starting with the fact that it wasn't published until 1980, 11 years after Toole committed suicide in 1969. The notion that A Confederacy of Dunces could be adapted as a movie goes back some 30 years, and even that story is one of significant coincidence. Back in 1982, Harold Ramis (Caddyshack, Groundhog Day) scheduled a meeting at Universal Pictures to discuss the movie with John Belushi... and then Belushi died a few days before the meeting. This started what some might almost call a curse (but probably has more to do with the sometimes short lives of heavyset American men), as in later years, John Candy and Chris Farley were also considered for A Confederacy of Dunces, and then... they both died too (Will Ferrell was also attached at one point, but happily, it didn't kill him). All of that set up leads us to this much buried lead: Zach Galifianakis is now attached to star as Ignatius J. Reilly in A Confederacy of Dunces. The project is now the subject of negotiations with director James Bobin, the cocreator of HBO's The Flight of the Conchords, who made his feature debut last year with The Muppets. A Confederacy of Dunces is being developed by producer Scott Rudin and Paramount Pictures, who have hired screenwriter Phil Johnston (Cedar Rapids) to adapt Toole's tale of an odd man and all of the people he knows and meets in New Orleans' French Quarter.

#2 GARY OLDMAN WILL BE THE GEPETTO/FRANKENSTEIN BEHIND THE REBOOTED... ROBOCOP

Darren Aronofsky may have long since departed MGM's reboot of Robocop, but it's starting to look like there are still reasons for movie fans to be excited that maybe the reboot won't be an abomination. Namely, Gary Oldman has signed a deal with MGM to play a scientist named Norton who creates the Robocop technology, and "finds himself torn between the ideals of the machine trying to rediscover its humanity and the callous needs of a corporation." There really wasn't much of a character like that in the original film, unless this Norton is somehow related to Bob Morton, the OCP executive played by Miguel Ferrer. This also all ties into what director Jose Padilha (Elite Squad, Bus 174) has already said about how his version will differ from the original. Explaining how his movie will be very much about the story not told originally, Padilha said, "My movie is between those two cuts. How do you make Robocop? How do you slowly bring a guy to be a robot? How do you actually take humanity out of someone and how do you program a brain, so to speak, and how does that affect an individual?" Robocop himself, AKA Alex Murphy, will be played by Joel Kinnaman (The Darkest Hour). Filming is scheduled to start in Toronto in September, 2012, and MGM is currently eyeying a release sometime in the summer of 2013.

#3 SANDRA BULLOCK JOINS THE DE FACTO BRIDESMAIDS REUNION PROJECT

There's been a lot of talk over the last year about what the various people behind Bridesmaids will be doing next. Now, we have the answer for director Paul Feig, who also directed Unaccompanied Minors in 2006 and created the TV show Freaks and Geeks. The comedy will also reunite Paul Feig with Melissa McCarthy, who garnered dozens of nominations for Bridesmaids. McCarthy will play an "unconventional" Boston cop who has to team up with an "uptight" FBI agent played by Sandra Bullock, who previously played an agent (but probably a different one) in the two Miss Congeniality movies. The untitled comedy was written by Katie Dippold, a writer and producer of episodes of MADtv and Parks and Recreation. 20th Century Fox is hoping to get production on this comedy started sometime this summer while Melissa McCarthy is on hiatus from her CBS sitcom Mike & Molly.

#4 THE IAN FLEMING BIOPIC TO START FILMING THIS YEAR AS PART OF THE JAMES BOND GOLDEN ANNIVERSARY

The James Bond film franchise turns 50 this year, and the golden anniversary is being celebrated commercially in a few different ways, including the release of Skyfall in November, and a massive Blu Ray boxed set of all the films to date. Bond's creator, Ian Fleming, will himself be directly involved with all of this (well, as directly as can be for someone who died in 1964), as he will be the subject of Fleming. The long planned biopic will tell the true story of how Fleming's own experiences as a Naval Intelligence Officer led to the creation of the world's most famous (fictitious) super spy. After a search that included Gary Ross and Francis Lawrence (coincidentally, the directors of The Hunger Games and its upcoming sequel, Catching Fire), the director job for Fleming has gone to Duncan Jones, the David Bowie progeny who made his auspicious debut with Moon and whose second film was Source Code. Fleming will be a British production in association with Fleming's estate, and will be based upon the book Ian Fleming: The Man Behind James Bond by Andrew Lycett. Duncan Jones is currently casting up, and production is expected to start by the end of 2012.

#5 ZAC EFRON AND SETH ROGEN TEAM UP FOR TOWNIES

Director Nicholas Stoller got his film career started with a hit in the form of Forgetting Sarah Marshall, which was followed by the spinoff Get Him to the Greek, and continued this year with The Five-Year Engagement. Now, Stoller is lining up his fourth film, and it will be the first movie that doesn't either star Jason Segel, or is a spinoff of a movie starring Jason Segel. That movie is called Townies, a comedy for Universal Pictures, that will star Seth Rogen and Zac Efron as two guys on either side of a turf war between a "family man" (Rogen) and a hard-partying fraternity member (Efron). Townies got its start last summer as the subject of a bidding war between the studios, and is seen as a top priority, so it is likely that filming will start relatively soon.

#6 PETER BOGDANOVICH WILL RETURN WITH SQUIRRELS TO THE NUTS

It is literally cinema history now, but there was a time when Peter Bogdanovich was one of the hottest screenwriters/directors in Hollywood, as a member of the "New Hollywood" scene of the 1970s. Bogdanovich's career included such films as Mask, Paper Moon, and The Last Picture Show, and he has also long been prolific as an expert on film history, aided greatly by his early friendships with such old school directors as John Ford, Alfred Hitchcock, Howard Hawks and Orson Welles. However, along the way, Bogdanovich's own career as a screenwriter and director sort of hit the brakes, with his last film as director (The Cat's Meow) opening way back in 2001, and his last film as screenwriter even further back (Texasville in 1990). In an arc that is quite circular considering what Bogdanovich did for some of those old time directors, he is now the benefactor of younger directors Wes Anderson and Noah Baumbach, who are helping him get a new movie made. That movie is called Squirrels to the Nuts, and it's about a New York prostitute whose "business" with a Broadway director leads to her getting a new career on the stage. Brie Larson will be that "working girl," Owen Wilson will play the director, and Olivia Wilde will play a "therapist dealing with her own mother's alcoholism."

#7 MORE VILLAINS GET CAST IN BOTH THOR 2 AND IRON MAN 3

As The Avengers continues to smoke just about any other film released this month, development of the sequels for two of that film's central characters continued with much haste and activity this week. And the theme was villains! Mads Mikkelsen is a Danish actor who is probably best known for playing the villain Le Chiffre in Casino Royale, and he also had roles in King Arthur (2004), Valhalla Rising, and Clash of the Titans. Mikkelsen's Nordic ancestry arguably makes him sort of inevitable for any short list for future Thor casting, and sure enough, he's in talks to play one of (if not "the") the villains in Thor 2. Now, that's pretty much all we know, so any further speculation on who that might be will have to remain in the realm of fan chat for now. Some possibilities, however, could be Skurge the Executioner (especially if Amora the Enchatress is the other villain), or maybe someone like Malekith the Accursed, if the storyline focuses more on the Dark Elves of Svartalfheim. Meanwhile, over in the Iron Man 3 production offices, relatively unknown actor Ashley Hamilton (Sunset Beach) has landed a small role as the super armored villain Firepower. The addition of a relatively unknown villain (who is more memorable for the story that introduced him than his legacy as an actual character) is particularly interesting when we factor in another hiring from last week. James Badge Dale (AMC's Rubicon) was cast to play Eric Savin, AKA Coldblood, another "wait... who's that again?" nearly unknown Marvel super villain. On the bright side, the inclusion of lesser known villains for the movies might be seen as a good thing in that it means the script isn't being written just to fit in popular villains just... because. Lesser known characters might service the story of this film better... we don't know. And in other news... Jon Favreau may not be directing Iron Man 3 (Shane Black of Kiss Kiss Bang Bang is), but he will still be on set anyway, because he's returning as bodyguard/chauffeur Happy Hogan.

#8 THE VIDEO GAME MOVIE CURSE... CAN SHADOW OF THE COLOSSUS FARE ANY BETTER THAN MOST?

After Hollywood got its first look at the super-powered-teens movie Chronicle back in January, that film's director Josh Trank has since lined up three different comic book adaptations at various studios (Red Star, Venom and the Fantastic Four reboot). But to paraphrase the old show business expression, what Josh Trank may have really wanted to do was make a video game adaptation, delving into a collective source material that thus far has not had its own Blade/X-Men moment, marked by increased and frenzied Hollywood interest. Trank has signed with Sony Pictures for an adaptation of the 2005 PS2 game Shadow of the Colossus from Japanese developer Team Ico. In the fantasy game, a young adventurer named Wander has to explore a vast expanse on horseback searching to defeat sixteen massive monsters to restore life to his girlfriend. Trank has long been a fan of Shadow of the Colossus and basically sought this project out, and it is his interest that may be the key to it actually getting made someday.
